If you are not up on all of my sites, you may not know that I'm currently involved in a bitter battle of intellect with an idiot called Notes From The Underground. Because this moron has angered me, I've decided all of my resources are now geared to his downfall. Notes is a liberal who is blindly defending the rogue organization known as the American Civil Liberties Union. He has taken issue with my criticism of that Communist organization. And used a decision by the United States Supreme Court in defense. But why he did I'm not sure. The case that he cited involves something similar, but different than the issue.

The original point was that the ACLU is more concerned with granting United States Constitutional protections to foreign terrorists who are being detained at the marine base at Guantanamo Bay, Cuba than those of United States citizens. These terrorists were not captured in the United States. They have not lived in the United States. They are not citizens of the United States. And they are not being held in the United States. The Court case cited by Notes is, Ex Parte Quirin which was a petition for leave to file habeas corpus. The petitioners were Nazi spies captured in the United States in 1942. All of these spies were once living in the United States. One of the spies was a citizen of the United States. All of them returned to their native Germany when war in Europe broke out. In Germany they all received military training and training in explosives and resisting interrogation. They were all then returned to the United States in two groups via submarine. One landed in New York, the other in Florida. They landed wearing German Marine uniforms. After landing they changed out of their uniforms and donned civilian clothing, They then burried their uniforms. They then set out to cause damage to military material factories. The petition of the spies was denied by the Supreme Court.

News contends that the detainees at Guantanamo are entitiled to relief in the federal court system because of Ex Parte Quirin. Constitutional protections are granted to all US citizens and foreigners who committed their crime in the United States or are being held in the United States. The detainees are none of the above. They are enemy POWs and beligerant non-combatants and are subject to trial by military tribunal. The Department of Defense can hold any or all of them until hostilities against the United States by the powers to which they belong are ended. At which time the Department of Defense either has to re-patriate them to their countries of origin or hold a military tribunal and charge the detainees with crimes.

But Notes don't understand this. And I am making it my point to make sure he does.
